Guyana passes new law to better protect children across borders

Guyana has taken another big step to protect the rights and safety of children by passing a new law that will help deal with complex family issues involving children across different countries.

The International Measures for the Protection of Children (Hague Convention) Bill was successfully passed in the National Assembly on Monday evening. It was tabled by Minister of Human Services and Social Security, Dr. Vindhya Vasini Persaud.

“This law speaks to parental responsibilities, reduces unnecessary delays, and helps decide which country’s court should deal with child protection matters,” Minister Persaud said.

“It gives the Hague Convention full legal power in Guyana for a second time and shows our strong commitment to protecting children,” she added.

The new law means that Guyana now follows international rules to protect children, especially in situations like custody disputes, international adoption, and cases where children are moved across borders.

It covers children from birth to 18 years old, and protects not only their well-being but also their property.

Dr. Persaud added that this law also recognises the challenges families face today, especially when parents live in different countries or relationships break down. It helps to deal with such matters more fairly and smoothly, putting the child’s best interest first.

The law allows for a Central Authority in Guyana to manage cross-border child protection cases; the High Court to deal with these matters and even apply laws from another country when needed.

It also allows for decisions made in other countries to be recognised and enforced in Guyana and clear rules and cooperation with courts and authorities in other countries that are also part of the Hague Convention.

In the past four years, Guyana has drafted four laws to align with the Hague Convention. Two of them, including this new one, are now official laws. The other law relates to inter-country adoption.

Minister Persaud thanked the Ministry of Legal Affairs and everyone who supported the process, saying it was a proud moment for the government and the country.

“This is about making sure every child is protected—no matter where they are,” she said.
