Court hears voir dire as Elections fraud trial moves forward

The ongoing trial into alleged irregularities surrounding the 2020 General and Regional Elections continued Tuesday with the court hearing evidence in a voir dire involving one of the accused, Enrique Livan.

Livan was an Information Technology Officer at the Guyana Elections Commission (GECOM) during the 2020 elections.

He is being accused of being involved in a flash drive scandal on March 5, 2020 at the Ashmin’s Building in Georgetown during the plot to derail the electoral process.

Tuesday’s proceedings centred on Livan, as the court examined the admissibility of certain evidence in the case.

A voir dire is a pre-trial legal process used to determine whether specific evidence can lawfully be presented during the trial. By law, the substance of testimony given in this stage cannot be publicly disclosed.

The matter is being heard before acting Chief Magistrate Faith McGusty at the Georgetown Magistrates’ Court.

During the void dire, several law-enforcement witnesses were called to testify. Assistant Superintendent Komal Pitamber was first to take the stand, followed by Police Corporal Trevor Moore and Detective Inspector James. Livan himself also gave evidence before the magistrate as part of the hearing.

The trial recommenced on Monday after being adjourned for more than two months and is being conducted under case-management procedures intended to streamline the presentation of evidence.

Nine persons including former Chief Elections Officer Keith Lowenfield, former Deputy Chief Elections Officer Roxanne Myers, former Region Four Returning Officer Clairmont Mingo, and former minister Volda Lawrence are before the court.

They face allegations that they conspired to manipulate Region Four tabulation figures in favour of the APNU+AFC coalition, thereby denying victory to the People’s Progressive Party.

The trial is scheduled to continue throughout the week.
